CreativePass Terms of Use

1. Acceptance of Terms

By downloading, installing, or using CreativePass (“App,” “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, you must not use the App.

These Terms form a legally binding agreement between you (“User”) and MoonBear LLC, the developer of CreativePass.

2. Description of Service

CreativePass is a professional photo and video editing application that allows users to:

• Apply LUTs and color grading

• Edit photos and videos

• Export edited media

• Import custom LUTs

• Use real-time visual effects tools

The App operates using a local-processing architecture, meaning your media is processed directly on your device rather than transmitted to external servers.

3. Eligibility

You must be at least 13 years old to use CreativePass. By using the App, you represent that you meet this requirement.

If you are under the age of majority in your jurisdiction, you must have parental or guardian permission.

4. License Grant

Subject to these Terms, MoonBear LLC grants you a limited, non-exclusive, non-transferable, revocable license to use CreativePass for personal or professional media editing purposes.

You may not:

• Copy or redistribute the App

• Reverse engineer or decompile the software

• Resell or sublicense the App

• Use the App to create competing software

5. Ownership & Intellectual Property

All rights, title, and interest in CreativePass — including software code, design, branding, UI, and features — are owned by MoonBear LLC and protected by copyright, trademark, and intellectual property laws.

You retain ownership of:

• Your photos

• Your videos

• Your imported LUTs

• Your exported content

CreativePass does not claim ownership of user media.

6. User Content Responsibilities

You are solely responsible for any media you import, edit, or export using CreativePass.

You agree not to use the App to process or distribute content that:

• Violates laws

• Infringes copyrights

• Contains illegal material

• Violates privacy rights

• Is defamatory or abusive

CreativePass does not monitor or access your media files because they are processed locally.

7. Privacy

Your use of the App is also governed by the CreativePass Privacy Policy.

Key principles:

• Media is processed locally

• No face data is collected or stored

• No biometric identifiers are created

• No media is transmitted to servers

By using the App, you acknowledge and agree to the privacy practices described in the Privacy Policy.

8. Purchases & Payments

CreativePass is sold as a one-time purchase through the Apple App Store.

All payments, refunds, and billing matters are handled exclusively by Apple and are subject to Apple’s terms and policies.

MoonBear LLC does not process payment information.

9. Updates & Modifications

We may update or modify CreativePass at any time, including:

• Feature additions

• Performance improvements

• Bug fixes

• Security updates

We may also modify these Terms. Continued use after changes means you accept the updated Terms.

10. Availability

We do not guarantee uninterrupted or error-free operation of the App.

We reserve the right to:

• Suspend features

• Modify functionality

• Discontinue the App

at any time without notice.

11. Disclaimer of Warranties

CreativePass is provided “AS IS” and “AS AVAILABLE.”

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

• Fitness for a particular purpose

• Merchantability

• Non-infringement

• Accuracy of results

We do not guarantee that edits, exports, or effects will meet your expectations or professional requirements.

12. Limitation of Liability

To the maximum extent permitted by law, MoonBear LLC shall not be liable for:

• Data loss

• Media corruption

• Device issues

• Lost profits

• Indirect damages

• Consequential damages

Total liability shall not exceed the amount you paid for the App.

13. Indemnification

You agree to indemnify and hold harmless MoonBear LLC from any claims, damages, or legal fees arising from:

• Your use of the App

• Your media content

• Your violation of these Terms

• Your violation of any law or third-party rights

14. Third-Party Services

CreativePass interacts only with limited system-level services:

• Apple App Store (distribution & updates)

• iOS frameworks (camera, photos, microphone)

These operate under their own terms and privacy policies. We are not responsible for third-party services.

15. Termination

We may suspend or terminate your access if you violate these Terms.

You may stop using the App at any time by uninstalling it.

16. Governing Law

These Terms shall be governed by the laws of the United States and the State in which MoonBear LLC is registered, without regard to conflict of law principles.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and MoonBear LLC regarding CreativePass.
